So it’s finally over, after eighteen months of campaigning, billions of dollars spent and a sleepless Tuesday night in November, the US election of 2012 finally drew to an end. So what can we take away from this contest? The first thing to take away is the lack of any real change. Going into this election there was a democratic president, a Republican house of representatives and a Democratic senate. Coming out of this election there is a democratic president, a Republican house of representatives and a Democratic president. However underneath the continuity, there is profound change taking place in the American election.

The headline from Lord Sumption’s Bar Council Law Reform Lecture was that it will be 2062 before we have a truly (ethnically) diverse judiciary in this country.[i] He advocates against so-called­ positive discrimination, which he says is the only way to diversity reflective of society could be achieved more quickly, while paradoxically calling for a debate on positive discrimination.
